Abstract
The purpose of this article is to analyze the disproportionality in the use of force by the National Police of Peru (PNP) during protests. To address the research, a qualitative and documentary phenomenological methodology was adopted. It is established that the use of police force in Peru is not being appropriately employed against demonstrators, as protests are often criminalized for stigmatizing and discriminatory reasons, wrongly justifying excesses that lead to violations of human rights concerning the rights to political participation, expression, assembly, and freedom of association, primarily affected due to inaction regarding the needs of the population. Consequently, the intention is to offer a solution to the problem through the use of international instruments that provide guidelines and effective parameters for state action, as well as an expansion of the content of the use of force with a human rights perspective.
